General Terms and Conditions of Sale – Prooviloor.ee
The owner and operator of the online store Prooviloor.ee (hereinafter the “Online Store”) is Hettel Trading OÜ (registry code 17094459), located at Voki vkt 5-4, Sihva küla, 67301 Otepää vald, Valga maakond, Estonia.
Validity of the sales contract, product and price information
These terms and conditions apply to the purchase of goods from the Online Store. The prices of products sold in the Online Store are indicated next to each product. Delivery charges are added to the price. The delivery fee depends on the buyer’s location and chosen delivery method. The delivery fee is displayed to the buyer during the order process. Product information is provided directly next to each item in the Online Store.
Placing an order
To order goods, add the desired products to the shopping cart. To complete the order, fill in the required fields and select a suitable delivery method. The total amount payable will then be displayed, which can be paid via bank link or other available payment methods. The contract enters into force upon receipt of the payable amount into the Online Store’s bank account. If the ordered goods cannot be delivered due to stock exhaustion or for any other reason, the buyer will be notified as soon as possible and the paid amount (including delivery costs) will be refunded, usually within 1–2 working days. Depending on the payment method, crediting may take up to 7 working days.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland. The buyer bears the shipping costs, and the relevant pricing is displayed next to each shipping option. Domestic shipments in Estonia generally reach the buyer’s specified destination within 3–7 working days from the entry into force of the sales contract. Outside Estonia, delivery takes place within calendar days. In exceptional cases, the Online Store has the right to deliver the goods within up to 30 calendar days. If the Online Store has informed the buyer on the website or in the order confirmation of delivery issues and a deadline exceeding 30 calendar days, the deadline announced by the Online Store applies.
Right of withdrawal
After receiving the order, the consumer buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. [Note: Depending on the products, the right of withdrawal may not apply to certain items. Such products and services must be listed here and must comply with the conditions listed in § 53(4) of the Law of Obligations Act (VÕS). Currently, ProoviLoor products (both reusable and disposable protective veils) are generally eligible for withdrawal as they are not custom-made, perishable, or sealed hygiene items opened by the consumer in a way that prevents resale.] The right of withdrawal does not apply if the buyer is a legal person (business customer). To use the 14-day right of withdrawal, the ordered goods must not be used in any way other than is necessary to ascertain the nature, characteristics, and functioning of the goods in a manner similar to testing in a physical store. If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount proportionally to the decrease in the value of the goods. To return the goods, the buyer must submit a withdrawal notice to our email address info@prooviloor.ee no later than 14 days after receiving the goods. The buyer bears the cost of returning the goods, unless the return is due to the fact that the item does not correspond to the order (e.g., wrong or defective item). The buyer must return the goods within 14 days after submitting the withdrawal notice or provide proof that the goods have been handed over to the carrier within that period. The Online Store refunds all payments received from the buyer under the contract immediately upon receipt of the returned goods, but no later than 14 days after receiving the withdrawal notice. The Online Store may refuse to make refunds until it has received the returned goods or until the buyer has provided proof of returning them, whichever occurs first. If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to refund the costs exceeding those associated with the standard delivery method. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price in the Online Store was mistakenly listed significantly below the market price of the goods.
Right to file a claim (warranty)
The Online Store is liable to the buyer for non-conformity of the sold goods with the contract terms or for defects that existed at the time of delivery and become apparent within two years from the handover of the goods to the buyer. During the first year after handover, it is presumed that the defect already existed at the time of delivery. It is the Online Store’s obligation to rebut this presumption. If a defect appears, the buyer has the right to contact the Online Store no later than two months after becoming aware of it by sending an email to info@prooviloor.ee or calling +372 5596 9059. The Online Store is not liable for defects that arise after delivery due to the buyer’s actions or omissions (incorrect use, accident, etc.) or for normal wear and tear resulting from ordinary use of the goods. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund all payments related to the sales contract. The Online Store will respond to the consumer’s complaint in writing or in a reproducible form within 15 days.
